Shaw Mechanical Expansion Plugs Limited Warranty

SHAW DEVELOPMENT, LLC ('SHAW') warrants to the original product purchaser (hereinafter 'the Customer') that the SHAW product for which the Customer is entitled to receive this warranty was designed, developed and/or fabricated using all due reasonable commercial care and good manufacturing practices. SHAW's product shall be free from defects in material and workmanship for one year from date of purchase. SHAW's sole obligation under this warranty is to repair or replace the product, at SHAW's option. SHAW and their authorized affiliates must be notified in writing of any claim under this warranty within 30-days of any claimed lack of conformity of the product.
Warranty Limitations. In no event shall SHAW and their authorized affiliates be liable for any loss, inconvenience or damage, whether direct, incidental, consequential or otherwise, resulting from breach of any express or implied warranty or condition, of merchantability, fitness for a particular purpose or otherwise with respect to this product, except as set forth herein. Shaw makes no warrants or product claims to specific product application and/or performance. Shaw Plugs are designed for low pressure containment. All applications for Shaw Plugs should be tested and verified by the Customer in a safe and secure environment and the responsibility for any and all such actions falls solely on the Customer. This warranty will be interpreted pursuant to the laws of the United States and the State of Florida. This warranty is not intended to confer any additional legal, jurisdictional or warranty rights to the Customer other than those set forth herein or required by law. If any portion of this warranty is held to be invalid or unenforceable for any reason, such finding will not invalidate any other provision. No entity, person or persons, including authorized affiliates of Shaw may make any representations, guarantees or warranties (whether written or oral) regarding the efficacy or any other characteristics of the Products on Shaw's behalf other than as contained in written promotional literature prepared by Shaw, or as required by any governmental law, regulation or agency.

Shaw Plugs are not rated and/or approved for any general or specific aviation usage including those defined by, but not limited to, The FAA and Industry Guide to Avionics Approval including any and all avionic product certifications. Shaw Plugs are not rated for volatile liquid containment (OSHA).

Warranty product replacement claims may include a scrap-in-field directive that may only be given by SHAW. Any insurance and/or shipping costs incurred in returning the SHAW product for warranty replacement must be approved by SHAW. Failure to obtain this return authorization approval will result in all associated insurance and/or shipping costs to be the sole responsibility of the Customer. SHAW and their authorized affiliates will not be responsible for any products lost or damaged in shipment. Contact your Authorized Shaw Plugs Distributor or Shaw Development, LLC for return authorization approval.

Warranty Exclusions
Representatives and authorized affiliates of SHAW products are not sanctioned to modify this warranty in any way. It is the Customer's responsibility to regularly examine the product to determine the need for normal service or replacement. This warranty does not cover the following:
  • Products that have been modified, neglected or poorly maintained, misused, abused or involved in accidents or natural disasters.
  • Damage occurring during shipment of the product (such claims must be presented directly to the freight forwarder or shipping company).
  • Damage to the product resulting from improper maintenance or repair, the use or installation of parts and/or accessories that are not compatible with the original intended use of the product, or the failure to follow the product warnings and usage instructions.
  • Damage or deterioration to the surface finish, aesthetics or appearance of the product.
  • The labor costs required to remove and/or refit and readjust the product covered by this warranty.
  • Normal wear and tear to the product.
  • Or, any products for which the Customer does not follow the warranty procedures outlined above.
